Terms of Use (EULA)

These Terms of Use ("Terms") form a legally binding agreement between you and Finon Ltd ("Finon", "we", "us", or "our") governing your access to and use of the Finon mobile application and related services (together, the "Service"). They also serve as the End User License Agreement (EULA) for the Service.

Please read these Terms carefully. By downloading, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not download or use the Service.

Eligibility

You must be at least 18 years old and able to form a legally binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements. The Service is intended for personal, non-commercial use.

The Service

Finon is a financial dashboard that lets you connect your bank, brokerage, and cryptocurrency accounts to view and track your portfolio in one place. Connections are made through third-party account-connection providers on a read-only basis, which means Finon is designed to view your account information and cannot move, transfer, or transact with your funds.

Not financial advice. The Service provides information, aggregation, and analytical tools for your personal use only. It does not constitute financial, investment, tax, legal, or other professional advice, and nothing in the Service is a recommendation to buy, sell, or hold any asset. You are solely responsible for your financial decisions. Account balances, valuations, and other figures are provided for convenience, may be delayed or inaccurate, and should be verified with your financial institution before you rely on them.

Account Connections and Third-Party Services

To use core features, you may link external financial accounts through third-party connection providers. Your use of those providers and of your financial institutions remains subject to their own terms and privacy practices, and we are not responsible for them. We do not control, and are not responsible for, the availability, accuracy, or security of any third-party service, and we are not liable for any loss arising from your use of, or reliance on, any third-party service. You authorise Finon and its providers to access and retrieve your account information on your behalf for the purpose of providing the Service.

Your Account and Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information and to keep it up to date. Notify us immediately at [email protected] if you suspect any unauthorised use of your account or any security breach.

Subscriptions and Purchases

Some features of the Service require a paid subscription or a one-time purchase, sold through the Apple App Store and managed by your Apple Account. Finon currently offers:

The title, length, and price of each plan, together with any introductory offer or free trial, are shown in the app and on the App Store at the point of purchase, in your local currency.

Auto-renewing subscriptions

• Payment is charged to your Apple Account at confirmation of purchase.
• A subscription automatically renews for the same period at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your Apple Account is charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel your subscription, and turn off auto-renewal, in your Apple Account settings after purchase.
• If a free trial is offered and you purchase a subscription, any unused portion of the free trial is forfeited.

Billing grace period

If a renewal payment fails, eligible subscribers may keep access to paid features during a billing grace period of 16 days while Apple attempts to recover the payment. The grace period applies to eligible paid-to-paid renewals as determined by Apple. If payment is not recovered within the grace period, access to paid features ends.

Finon Lifetime

Finon Lifetime is a single, one-time purchase that does not auto-renew and is not a subscription. It grants access to the included features for as long as the Service is offered, subject to these Terms.

Price changes, cancellation, and refunds

We may change subscription prices from time to time. Any price change will apply only to renewals occurring after the change, and where required we will give you advance notice and the opportunity to cancel before it takes effect. All purchases are processed by Apple, and refund requests are handled by Apple in accordance with its policies; we do not directly process refunds for App Store purchases. You can request a refund through Apple's support channels.

Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorised access to the Service or to any account, system, or network; (c) copy, modify, reverse engineer, decompile, or create derivative works of the Service except to the extent permitted by law; (d) interfere with or disrupt the integrity or performance of the Service; or (e) use the Service to infringe the rights of others.

Intellectual Property

The Service and all of its content, features, and functionality are and remain the exclusive property of Finon Ltd and its licensors, and are protected by United Kingdom and international intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service. No rights are granted except as expressly set out in these Terms.

Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any data shown will be accurate or complete. Nothing in these Terms excludes or limits any rights you have under mandatory consumer protection law that cannot lawfully be excluded.

Limitation of Liability

To the fullest extent permitted by law, Finon Ltd and its directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or financial loss, arising out of or in connection with your use of, or inability to use, the Service. Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence or for fraud.

Termination

We may suspend or terminate your access to the Service at any time if you breach these Terms or if we discontinue the Service. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, and governing law.

Changes to These Terms

We may update these Terms from time to time. If a change is material, we will take reasonable steps to notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree, please stop using the Service.

Governing Law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that this does not deprive you of the protection of mandatory consumer law in your country of residence.

Apple App Store Terms

The following terms apply because the Service is made available through the Apple App Store. In them, "Application" means the Finon app and "Licensed Application End User License Agreement" means these Terms.

• Acknowledgement. These Terms are concluded between you and Finon Ltd only, and not with Apple. Finon Ltd, not Apple, is solely responsible for the Application and its content. These Terms do not provide for usage rules for the Application that are less restrictive than, or in conflict with, the Apple Media Services Terms and Conditions.
• Scope of Licence. The licence granted to you for the Application is a non-transferable licence to use the Application on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the Application may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
• Maintenance and Support. Finon Ltd is solely responsible for providing any maintenance and support services for the Application. Apple has no obligation to furnish any maintenance and support services for the Application.
• Warranty. Finon Ltd is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the Application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Finon Ltd.
• Product Claims. Finon Ltd, not Apple, is responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of the Application, including: (a) product liability claims; (b) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
• Intellectual Property Rights. In the event of any third-party claim that the Application or your possession and use of the Application infringes that third party's intellectual property rights, Finon Ltd, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.
• Legal Compliance. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

• Third Party Terms of Agreement. You must comply with applicable third-party terms of agreement when using the Application (for example, your wireless data service agreement).
• Third Party Beneficiary. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
